User Agreement

1. Terms and Definitions

The following terms and definitions are used in this Agreement:

Service — the sobes.tech software and the https://sobes.tech website, which provide functionality for capturing and recognizing voice speech, generating text responses, displaying information, and adjusting visual parameters.

User — an individual using the Service and accepting the terms of this Agreement.

Executor — Kuryatin A.A., TIN: 711204675707, the owner and administrator of the Service.

Content — any text, audio, or graphic materials created or processed using the Service.

Agreement — this document, which governs the relationship between the Executor and the User.

2. Subject of the Agreement

This User Agreement (hereinafter referred to as the "Agreement") governs the relationship between the Executor and the User when using the Service.

Acceptance of this Agreement is considered to be the User's registration in the Service or payment for the paid features of the Service. The date of acceptance is the date of registration or the date of receipt of funds into the Executor's account. Use of the Service means the User's full and unconditional acceptance of the terms of this Agreement.

3. Service Description

The Service is a desktop application and a remote server part that provide the User with tools for:

• capturing and recognizing voice speech;
• generating text responses, possibly containing code;
• displaying information in the user interface;
• adjusting visual parameters (transparency, font size, etc.).

The Service's functions are available only with an Internet connection.

The results obtained using the Service are generated automatically and may contain inaccuracies, outdated, or incorrect information. The Service does not replace professional advice, and the User independently decides how to use the provided data.

The Executor has the right to update the functionality of the Service, including adding new functions or changing existing ones, without prior notice to the User, if this does not limit the already paid functions.

4. Rights and Obligations of the Parties

4.1. The User undertakes to:

• use the Service in accordance with the current legislation of the Russian Federation;
• not to interfere with the operation of the Service and not to take actions aimed at destabilizing its work;
• provide reliable information upon registration.
• refrain from abusing the Service, including sending an excessive number of requests or continuous use of the Service when it is not required;

4.2. The User has the right to:

• use the functionality of the Service within the framework of this Agreement;
• get access to paid functions after their payment;
• stop using the Service at any time.

4.3. The Executor undertakes to:

• provide technical access to the Service if possible;
• take measures to ensure the security of the User's data.

4.4. The Executor has the right to:

• suspend or restrict access to the Service in case of violation of the Agreement;
• make changes to the functionality of the Service;
• temporarily restrict access to the Service for technical reasons.

5. Use of Third-Party Services

To perform certain functions, the Service uses third-party APIs and platforms, including (but not limited to):

• VK Cloud, AI Speechkit;
• other third-party services.

Data transmitted to such services (voice or text) is processed in accordance with the privacy policies of the respective platforms.

6. Registration and Data Processing

Access to the Service's functions may require registration, during which the User provides:

• email address;
• password (stored in encrypted form).

Data is transmitted over secure channels and processed in accordance with the Privacy Policy.

7. Cost and Payment Procedure

Some features of the Service are provided on a paid basis. Current rates are available on the website https://sobes.tech/pricing. Paid functions are activated upon receipt of payment to the Executor's account.

Payment is made through third-party payment systems. The Executor does not store or process bank card data.

The purchased subscription package is valid for 15 or 30 days from the date of purchase. Refunds for unused subscription packages / credits are possible only in cases provided for by the legislation of the Russian Federation. To request a refund, the User must contact the Executor's email.

8. Liability of the Parties

The Executor is not responsible for:

• interruptions in the operation of the Service due to the fault of third-party platforms or providers;
• distortions or errors that occurred during data transmission to third-party services;
• defects, errors, bugs, and other technical malfunctions in the operation of the Service;
• the User's use of information obtained through the Service;
• indirect losses, lost profits, or other consequences related to the use of the Service, including cases where the Service does not meet the User's expectations, their specific goals, or when there are errors in the service's operation.

The User is responsible for compliance with the legislation when using the Service.

9. Responsibility for Recording Third Parties

The User is obliged to notify all participants of the audio recording (for example, in online conferences or calls) about the possible recording and processing of their data using the Service. The User bears full responsibility for obtaining the consent of third parties to the recording and processing of their personal data in accordance with the legislation of the Russian Federation.

10. Termination of the Agreement

The User has the right to stop using the Service at any time. To delete an account, you must send a request to the Executor's email.

The Executor has the right to terminate this Agreement unilaterally in the following cases:

• violation of the terms of the Agreement by the User;
• use of the User's account with multiple IP addresses simultaneously, if this indicates unauthorized access;
• actions of the User that create a threat to the stability of the Service.

11. Limitation of Guarantees of Stable Operation of Functions

The User acknowledges that the use of the Service is provided on an "as is" basis, without any guarantees of its error-free, uninterrupted, and stable operation.

The Executor does not guarantee the correct operation of all functional features of the Service. In particular, the function of hiding the program window from video capture may not provide the required protection when used with applications that implement non-standard methods of capturing images from the screen.

It is recommended that the User independently checks the performance of these functions in their work environment before their active use. The Executor is not responsible for any consequences, including technical failures or other inconveniences that have arisen as a result of using the Service.

12. Changes to the Terms of the Agreement

The Executor reserves the right to change this Agreement at any time. The changes come into force from the moment of their publication on the site. The User's further use of the Service means acceptance of the changes.

13. Irrevocability of Services

In the event of termination of use of the Service, all purchased services (for example, paid packages of credits) are considered non-refundable, unless otherwise established by the legislation of the Russian Federation or additional agreements between the Parties.
